Terms of Service

Please read these Terms of Service ("Terms") carefully before using the BeClarified platform operated by BeClarified Ltd ("BeClarified", "we", "our", or "us"). By accessing or using our service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using BeClarified in any way, you confirm that you are authorised to enter into this agreement on behalf of your dental practice and that you accept these Terms in full. If you do not agree to these Terms, you must not use the service.

2. Description of Service

BeClarified is a cloud-based dental practice management platform providing appointment scheduling, patient records management, treatment planning, business analytics, and related tools designed to help dental practices manage and grow their operations. Features may be updated, added, or removed at our discretion with reasonable notice.

3. Account Registration

To use BeClarified you must register for an account. You agree to:

  • Provide accurate, complete, and up-to-date registration information
  • Maintain the confidentiality of your login credentials
  • Notify us immediately of any unauthorised use of your account
  • Be solely responsible for all activity occurring under your account

Accounts are for professional use by registered dental practices only. You must be at least 18 years old to register.

4. Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose or in violation of applicable regulations
  • Upload malicious code, viruses, or disruptive content
  • Attempt to gain unauthorised access to any part of the service or its infrastructure
  • Reverse-engineer, decompile, or disassemble the software
  • Resell or sublicense access to the platform without our written consent
  • Use the service to store or process data in violation of applicable data protection laws (including UK GDPR)

5. Subscription & Billing

BeClarified is offered on a subscription basis:

  • Monthly Plan: Billed monthly at the current rate displayed on our pricing page
  • Annual Plan: Billed annually at a discounted rate (approximately 30% savings)

Payments are processed securely through our payment provider. Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date. We reserve the right to change pricing with 30 days' notice. All fees are non-refundable except where required by law.

6. Intellectual Property

BeClarified and its licensors own all rights in the platform, including software, design, trademarks, and content created by us. You are granted a limited, non-exclusive, non-transferable licence to use the service during your subscription.

Your Data: You retain full ownership of all patient records, clinical data, and other content you input into BeClarified. We claim no intellectual property rights over your data.

7. Data Protection

Your use of BeClarified involves the processing of personal data. You act as the data controller for patient data and BeClarified acts as the data processor. Our processing of your data is governed by our Privacy Policy and any applicable Data Processing Agreement. You are responsible for ensuring your use of the platform complies with applicable data protection laws.

8. Limitation of Liability

To the fullest extent permitted by law, BeClarified shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the service. Our total aggregate liability shall not exceed the total fees paid by you in the 12 months preceding the claim.

9. Termination

Either party may terminate the subscription at any time. Upon termination:

  • Your access to the service will cease at the end of the current billing period
  • We will retain your data for 30 days to allow export, after which it will be permanently deleted
  • We may immediately suspend access for material breach of these Terms

10. Disclaimers

The service is provided "as is" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose or uninterrupted availability. BeClarified does not provide medical or clinical advice; all clinical decisions remain the responsibility of the treating practitioner.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to Terms

We may revise these Terms from time to time. We will notify you of material changes with at least 14 days' notice via email or in-app notification. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
